The Decision of appointment of Serhiy Aksyonov to the post of the Chairman of the Council of Ministers of ARC, the decision of the Donetsk City Council of holding a referendum concerning the future fate of Donbass and the decision of holding a referendum concerning the status of Crimea, as well as resignation of the Government are illegitimate – stated the Minister of Justice of Ukraine Pavlo Petrenko.
“All these decisions are blatant violations of the Constitution of Ukraine and Laws of Ukraine and therefore are illegitimate”, - emphasized Pavlo Petrenko.
In particular, the appointment of Serhiy Aksyonov to the post of the Chairman of the Council of Ministers of ARC has been made with the violation of paragraph 4 of the Article 136 of the Constitution of Ukraine, paragraph 1 of the Article 37 of the Constitution of the ARC, approved by the Law of Ukraine of December 23, 1998 №350-XIV, sub-section 21 paragraph 2 of the Article 9 of Law of Ukraine “On Verkhovna Rada of ARC”, Article 7 of the Law of Ukraine “On Council of Ministers of ARC”.
The decision of holding a referendum concerning status of Crimea and the resignation of the Government has been made, as a matter of fact, at the premises of a captured building of the Verkhovna Rada of ARC and were fully falsified – as it was directed by the speaker of the Verkhovna Rada of ARC the voting had been made by duplicate cards rather than deputies of the Verkhovna Rada of ARC themselves who were absent during the voting.
“Moreover, this decision was made despite the fact that Article 137 of the Constitution of Ukraine does not provide the possibility of holding a local referendum to determine the independent status of ARC”, -stated the Minister of Justice.
Pavlo Petrenko emphasized that the local government bodies who had taken part in making these illegal decisions will incur liability for their actions established by law. Since the legislation of Ukraine provides clear legal mechanism for combating such unconstitutional actions. The Ministry of Justice will take all necessary measures to abolish the above said regulations
