Deputy Minister of Justice of Ukraine for European Integration Sergiy Petukhov and the Government Agent for ECHR Borys Babin have participated in high level consultations of Ukraine’s draft law “On the State Bureau of Investigation” held in Strasbourg, organized by the Council of Europe directorate general for human rights and rule of law.
During the discussion of the document, parties raised questions regarding observance of European principles of an effective investigation while developing the draft bill “On the State Bureau of Investigation”.
It is necessary to ensure effective investigation’s main criteria: independence, thoroughness, promptness, public control and involvement of victims to the process are the main ones.
Participants focused on requirements regarding investigation actions’ effectiveness and pointed out problematic aspects while investigating serious human rights violation, possibly committed by the State Bureau employees.
Members of the discussion have reached an agreement on the vision of further ways to improve legal and organizational mechanisms to prevent torture and ill-treatment in Ukraine.
Consultation results are going to be taken into account during the preparation of the above stated draft bill for a repeated second reading.
